So you don’t want your co-parent to be a guardian?

by Tessa Faverty 23 September 2010

Many single parents are confronted with the same problem…you don't want the co-parent to be guardian of your children on your death.

Unfortunately, unless there is good cause, the co-parent will be granted custody of your children on your death.

A good cause could be that the co-parent legally abandoned the child or children therefore relinquishing there parental responsibility. Alternatively the co-parent may be deemed an unsuitable parent, but this is generally quite difficult to prove without significant issues such as clear alcohol or drug abuse or mental health issues. If any of these issues arise, you may appoint someone else as guardian to your children but be aware of potential custody conflicts arising!
